Terms of use

These terms apply to the Starclear app by Lodevane, on iOS and Android. In Dutch the app is called Heldere Nacht, in German Sternklar. By using the app, you agree to these terms.

The service

Starclear gives, for each place and each hour, a forecast of cloud cover, moon and darkness, and a verdict on the night. The forecast comes from weather models of the Deutscher Wetterdienst and ECMWF. It is a probability, not a certainty: it may be late, incomplete or wrong. Do not use the app for decisions where harm may result, such as in aviation, on the water or for your safety. If you go to a dark place at night, look after your own safety and follow the local rules.

Pro

Pro is a monthly or yearly subscription that renews automatically. Before you buy, the App Store or Google Play shows the price, the term and any free first month; the store price applies. After a free month you pay the yearly amount, unless you cancel in time. The subscription renews at the end of each period, unless you cancel within the time limit the store states. You manage and cancel it in your Apple or Google account. Payment, cancellation and refunds go through the store and follow its terms.

If your subscription ends, your places and settings are kept, but the Pro features stop working.

Sources and changes

The forecast depends on sources we do not run ourselves. If a source changes or stops, a feature may change or disappear. We adapt the app where we can. If Pro becomes permanently and clearly worse, or we can no longer provide Pro, you get back the part of your payment for the period you miss. If we have to end Pro, we first stop sales and renewals, and tell you in the app. On Google Play we issue the refund ourselves. On the App Store only Apple can refund, through reportaproblem.apple.com; if that does not work, email us.

Fair use

We may change or interrupt the service: for maintenance, during an outage, when a source changes, or in case of misuse. You may not disrupt the service, get around its security or the limits of Pro, or automatically retrieve or republish the server's data without permission.

Rights in the app

The app, its design and its texts belong to Lodevane. You get a personal right to use the app on your own devices, within the rules of the store. For the app from the App Store, Apple's standard licence agreement also applies. The weather data comes from the Deutscher Wetterdienst and ECMWF, under the CC BY 4.0 licence. The attribution is in the app, under Settings, Sources and licences.

Liability

To the extent the law allows, we are not liable for damage caused by using the app, by the app being temporarily unavailable, or by a decision based on a forecast. This does not apply to intent or gross negligence, or to personal injury. Your statutory rights as a consumer remain unaffected.

Law and disputes

These terms are governed by Dutch law. If you live in another country, you keep the protection that the law of that country gives you as a consumer. Any dispute goes to the competent court.

Changes

We may change these terms. The date at the top shows when that last happened. A change does not apply retroactively to a period you have already paid for.
